Claims / Cancellations :
When it's either related to mail service or to transport systems, or to the loss of the goods or to a strike, SAM TAM sarl - Naiah Brand is not liable for excessive delivery time. Transport hazards are shouldered by the customer, who has the option to address a complaint to mail services or the carrier company, within three day of the originally stated delivery date.
Despite all the care taken and attention shown by SAM TAM sarl - Naiah Brand in the processing of parcels, there may be a missing product. Similarly, after transport, one of the products can turn out to be flawed.
Therefore, upon receiving the goods, the customer should check that all goods are in good condition. Any problem concerning the delivery (missing or damaged goods, damaged parcel) must be notified to the customer service department of SAM TAM sarl through the below Return Authorization Request form, the very day of delivery or, at the latest on the first working day following delivery. Any complaint addressed after this delay will be rejected and SAM TAM sarl - Naiah Brand will be released from any liability. SAM TAM sarl - Naiah Brand reserves itself the right to ask the customer to return the defective goods.
If the above-mentioned conditions are met, SAM TAM sarl - Naiah Brand will then send a refund for the flawed product(s), or will resend the missing product (if the request is reasonably grounded).

Cancellation rights :
All sold products benefit from the "satisfied or refunded" rule. In accordance with the law, within 7 days, customers have a right to cancel their purchase and to return the goods without the need to provide an explanation, in accordance with the conditions of the articles L 121 and following the French "Code de la Consommation" .
The 7 days delay starts from the delivery date. This right can be used by sending the goods back. Only postal costs are to be settled by the customer.

If the customer uses his 7 day cancellation time, SAM TAM sarl - Naiah Brand will refund the customer within the thirty days, by either bank transfer or by cheque depending on what the customer wants.

In accordance with SAM TAM sarl - Naiah Brand sales terms and conditions, only the goods returned in their original package will be accepted. Consequently, the return of items of clothing previously worn or washed as well as any damaged package will be refused.

Il appartiendra au client de conserver toute preuve de retour, ce qui suppose que les articles soient retournés par envoi recommandé ou par tout autre moyen donnant date certaine à cet envoi. Les frais de retour sont à votre charge, et vous êtes libre de choisir le type d'envoi. En cas d'erreur de livraison, SAM TAM Sarl – Marque Naiah prendra en charge vos frais de retour à hauteur du montant mentionné sur la preuve de dépôt que vous nous enverrez par fax ou par e-mail.

The cancellation right is enjoyed under same terms and conditions as of the order date and prior to delivery.

Guarantees :
Except when specified to the contrary, any item can be refunded or replaced.
In accordance with SAM TAM sarl - Naiah Brand sales terms and conditions, only the items returned in their original package (shoe box, plastic package...) will be accepted. Hence, returns of washed and/or worn clothing, as well as damaged packaging will be refused.
Refunds or Replacement can be requested within 7 day. The refund will be carried out within the thirty days, by either by bank transfer or by cheque, depending on what the customer wants. Except when SAM TAM sarl - Naiah Brand made a mistake in the delivery, postal charges are not refundable.

It will be up to the customer to keep any proof of the items being sent, which means that the goods were returned either by registered mail or any other means providing " Return Request " to choose whichever sending option he wants. In case of mistake in the delivery, SAM TAM sarl - Naiah Brand will settle the postage expenses amount as stated on the receipt that you will have sent to us by fax or e-mail.
In all the cases, any voucher or refund request will have to be issued through the below Return Authorization Request form.

All the items are subjected to a contractual guarantee, which does not cancel out the legal guarantee provided by the articles 1641 and the following French "Code Civil" articles.
